Memo and Recommendations for the Carrier

To ensure compliance with the terms of the TIR 1975 Convention, the Customs Code of the Russian Federation and to prevent violations of customs legislation in international road transport, the State Customs Committee of the Russian Federation reminds:
1. When carrying out international freight transportation, the driver acts as a representative of the transport operator.
2. Upon receipt of the cargo that is supposed to be transported, it is necessary to CHECK that all the necessary information has been entered in the documents. Shipping documents MUST contain information about the weight, quantity, nomenclature of the cargo, its codes in accordance with the Harmonized System for the Description and Coding of Goods, or according to TH FEA codes of the Russian Federation, indicating the first 4 characters (digits). The CMR waybill MUST contain an indication of a specific place cargo delivery (address and name of the customs office or its subdivision), as well as information about the place of temporary storage of cargo (name and address of the Temporary Storage Warehouse, license number, copy of the temporary storage warehouse license, and its expiration date).
3. Not later than 30 minutes after the end of the border and transport operator, the name of the customs office in the Russian Federation where he intends to go and at the same time submit transport and shipping documents to customs officers.
4. Border Customs SHALL SET the place of delivery where the transport operator (driver) MUST deliver the goods.
5. After completing and attaching the documents at the border, it is necessary to CHECK the seals and signatures (personal numbered stamps of customs officers, their signatures, date and place of delivery in columns 22 and 23 of the green CARNET TIR non-removable spine, customs stamp indicating the place of delivery and personal numbered stamp in CMR consignment note) must be affixed.
6. Border customs DO NOT HAVE THE RIGHT to refuse the transport operator (driver) to choose the best route if the regulatory documents of the State Customs Committee of the Russian Federation do not provide otherwise for similar transportation.
7. The driver MUST comply with the time limits and route set by the customs authorities.
8. In the event of a breakdown of the vehicle, damage to seals and seals or damage to the cargo compartment, the driver MUST take measures to ensure the safety of the cargo and immediately contact the nearest customs authorities.
9. It is NOT ALLOWED for the transport operator (driver) to independently introduce himself to the consignee, anywhere before the cargo is presented to customs, along with all documents, at the designated place of delivery.
10. Upon arrival at the designated place of delivery, the driver MUST place the vehicle and cargo outside the temporary storage warehouse and hand over the available documents to customs officers.
11. The customs authorities at the designated place of delivery DO NOT HAVE THE RIGHT to refuse the transport operator (driver) to accept the documents. Not later than three hours after the acceptance of documents, the customs authorities are OBLIGED to issue a written confirmation of arrival to customs to the transport operator (driver). This document remains with the driver.
12. The owner of the temporary storage warehouse at the designated delivery point DOES NOT HAVE THE RIGHT to refuse to place the cargo and the vehicle on the territory of the warehouse, AT ANY TIME OF THE DAY, regardless of whether he has an agreement with the transport operator or the consignee.
13. From the moment the cargo is placed on the territory of the temporary storage warehouse and until all customs formalities are completed or until the moment the cargo is received by the owner of the temporary storage warehouse, the transport operator (driver) is responsible for the safety of the cargo together with the owner of the warehouse.
14. As a rule, no later than two hours after the cargo is placed in the temporary storage warehouse, the customs authorities ISSUE the driver issued according to the CMR, CARNET TIR rules and the first copy of the Certificate confirming the delivery of goods (CCD), certified by the personal numbered seal of the customs officer. Departure from the territory of the warehouse without these documents is NOT ALLOWED.
15. When leaving the territory of the Russian Federation, the driver MUST submit to the border customs authorities the documents specified in paragraph 14. These documents MUST NOT BE LEFT with the customs officers, they must be attached to the Certificate confirming the vehicle’s exit from the territory of the Russian Federation.
16. At the request of the driver, customs officers are OBLIGED to provide the driver with their documents.
17. In the event of unforeseen situations, contact your transport company or a representative of the Forwarding company.
